special that city and state are to the country, obama urges sweeping effort to boost job creation. the moment they say is unusual for a state of the union. was the emotional call for congress to act on gun legislation calling the names, some of the victims of gun violence and families were there to hear it. >> gabby giffords deserves a vote, the families of newtown deserve a vote. the families of aurora deserve a vote. the families of oak creek and tucson and blacksburg and the countless other communities ripped open by gun violence deserve a simple vote. >> as for the republican response today on some of the issues laid out by the president, both speaker boehner and senate leader mitch mcconnell call the president's speech a missed opportunity.

>> an opportunity to bring together the country and instead became a retread of lip service and liberalism. for democratic president entering his second term, it was simply unequal to the moment. following four years of this president's unwillingness to challenge liberal dogma. we got more of the same. >> i have been dealing with a minimum wage issue for the last 28 years that i have been elected office. when you raise the price of employment, guess what happens. you get less of it. in a time when the american people are asking where are the jobs, why would we want to make it harder for small employers to hire people. >> let's bring in the "news nation" panel and syndicated talk show host and contributor michael smerconish, cnbc contributor and columnist for

reuters and the atlantic. lots of jobs for you. let me start off with you. you have a president talking about raising the minimum wage and the follow-up from republicans today is that that would hurt the jobs creators. an argument we hear often. is that an effective counter the day after for republicans? >> it might have been in the past, but i think the income disparity has taken such hold of the debate in the last year or 18 months, i think there is more momentum on the period's side for this issue than at any point previously. i discussed it on the radio and expected i would hear more opposition than i did. the people are ready for that kind of change. >> a couple of questions they said yesterday the president would need to answer. how can the united states create more jobs at home? did he adequately answer that? >> no, but this is in the realm

of commentary. one thing we encounter is that there is a limit to what they can do to create jobs and the expectation that obama would wave a magic wand is a bit of a fiction that we participate in. it would be good if we stop participating in. >> what about incentives for companies who choose not to hire them? >> that was not a focus on this. this is more about things we are going to do. tax breaks and incentives is they feel particularly in a state of the union moment as fuzzy. they are a lot more effective. >> i want to play what paul ryan said in reaction to the president's address. let me play it. >> he's taking to the road for the next few days in campaign mode. he seems to always stay in a campaign mode where he treats people, the other party as the enemy and not as partners. if he wanted to get things done he would work for us instead of

campaigning. >> he would work with us instead of campaigning around the country. is that fact, fiction or an opinion? >> it's just an opinion. every president does this after the state of the union. you saw it with gorge bush after he had the idea of privatizing social security. he went across the country to do that. this is a republican talking point. this idea that somehow obama doesn't want to work with the republicans and he is the who is obstructing poor progress in terms of the economy and other issues and he is always if campaign mode. it's not surprising that this is what they say again. i think you have a president that realizes he did well in 2012 and he has momentum and very much wants to go above the head of the folks in that audience. on the one hand, the audience was congress and also the american people. it's smart for him in keeping with what other presidents did. >> michael, with his stalemate

or fever as it is described, why wouldn't the president go over the heads of congress? we are seeing some compromise, perhaps in the horizon when it comes to immigration reform as a result of the notion that elections have consequences and we know the experience of the latino vote for the gop if they are to recover. why is that an ineffective strategy or going to be criticized by paul ryan as part of the losing team. why not go over the heads if that's the notion, of congress to the people who end up voting and getting perhaps the house change so that nancy pelosi becomes the speaker again as the president said is his desire when he addressed the members of the house in washington, virginia. >> i agree with the way she laid it out and said more simply, he is good at it on the road. if you are the opposition party, that's the last place you want him. when he is making appearances like today, the net of that is

pressure that gets put on members of congress. we listen to the president and he makes sense to us. that's why we want to keep him in washington. >> we want to play what the president had to say. you cannot cut prosperity and you see the cuts come down march 1st. let me play it. >> we can't ask senior citizens and working families to shoulder the entire burden of deficit reduction while asking nothing more from the wealthiest and the most powerful. we won't grow the middle class by shifting the cost of health care or college to families that are struggling. or by forcing communities to lay off more teachers and more cops and more firefighters. most americans, democrats, republicans, and independents, understand that we can't just cut our way to prosperity. >> mitch mcconnell said the sequester will happen and others

said the same thing. was there anything in the president's speech that moved the needle towards a compromise? >> the only thing that moves it is it's clear that the republicans and if you listen to connell, these were not energetic next day rebuttals. ryan looked like he was falling asleep. of all the programs, we were talking about clinton getting out the laundry list and how the president is going to pay for it. almost nothing he presented carries this massive price tag. the $9 new minimum wage is on private industry. the only thing that shifted, if it happens and it hits domestic programs, it's going to be the republicans who are responsible. that's a credible argument. if we step back and all this talk about the huge liberal expansion, it was liberal rhetoric. we are not talking about a lot of spending, but continuing to contract sequester or not. >> let me bring in david price

which by the way was the first stop for the president's post state of the union tour. thank you for your time. >> thank you. >> your colleague was just on with andrea mitchell and said the democrats need to produce a budget and everything falls into place, blaming the president and democrats for not producing a budget here. we are looking at sequester. mitch mcconnell said it will take place. some republicans believe that the democrats will be to blame for this. >> well, the notion that the president should sit down and work with paul ryan and his colleagues is just flying in the face of what these guys have said themselves in recent days. remember john boehner said he wasn't going to do any more big deals or even try. he knows these folks in the republican conference won't vote for anything. mitch mcconnell said the discussion is over and no more talk of revenues. just a summary statement.

what have they got to offer? are they sitting down to work it out? no. they offer yet another crisis and sequential series of efforts to shut it down so as to get their way. all they have got to offer is that and that means the sequester will come and a lot of republicans are saying let it come. in effect, don't worry about slowing down the growth rate and the job impact. let it come. >> the belief is that republicans think if it comes, folks say here are the democrats and the president asking for tax revenue as a solution and perhaps that will bring on heat. i will have to bring up what speaker boehner said. just before the state of the union saying that the president getting personal and saying he has no guts to stand up to his own party. matt lauer asking about that on the "today" show. here's what he said. >> during the debt talks, he didn't have the courage to take on the members of his own party.

i had troubles with my own party. no question about it. it was never about the courage to step up and do the right thing for the country. >> the president discussed the deal on the table back in december that included reforms to entitlements. he alluded to it last night in the state of the union, not in great detail. this notion that he is afraid to face the issues that might fire up republicans and progressives. >> when you look at the debt and deficit deals of the past in the 1990s, four years of balanced budgets, let us pay off 400 million. those look very much like obama's december offer to john boehner which john boehner just couldn't get the votes for. remember boehner had a fall back plan that was less ambitious. he couldn't get the votes for that. now he said this discussion is over. what do we conclude? obama made a good offer. he reiterated last night and

said we already cut a trillion and a half out of appropriated spending and some revenue out of the fiska will cliff deal and have a ways yet to go. let's have a balanced course as we work this out. the republicans have said we are not talking and the reality is the republican caucus is so extreme that they couldn't get the votes for a deal if they had one. >> thank you so much very much. the president is heading out of your home state on his first stop after the state of the union. let me get back to the panel here. i want to play what marco rubio had to say in the gop response prior to the water drink. prior or after. i don't know if anything matters. you take that sip of water and what he said about his personal story. >> this ideal is personal. my parents emigrated for the opportunity to improve their life. they made it to the middle class. my dad as a bartender and my

mother as a cashier and maid. i didn't inherit money from them. i live in the same middle class neighborhood i grew up in. i owed over $100,000. a debt i paid off just a few months ago. >> his story is not that mitt romney could tell or touch. chris matthews said rubio said government is not the answer, but talked about medicare for his mother and a student loan he received that perhaps allow him to be the senator that he is today. what do you make of the conflict there? >> i think that senator rubioey performance is fine. i am not hung up on the water incident. >> the issue of the role of government. >> substantively the short coming to answer the question is he didn't do anything in that speech to expand the tent. the issue that you raise about the role of government is an

example of where there koochb compromise, but it hasn't been forth comprehending. he had a good presentation, but the same set of remarks with a different and perhaps more appealing face delivering them. >> as you are talking about the substance, we are talking about the water. it was over 90,000 tweets. his issue about the role of government and we talked about this a lot. there is not just a mote, but there is maybe the grand canyon between the two parties over the role of government. these are ideological differences that will not be solved. >> it reminds you of the famous obama care saying government, hands off my medicare from the tea party. there is a greater realm of agreement amongst the american people about certain basic needs that government meets. whether it's roads and faa and

certain provision of health care and benefits to those who can't afford them. there is just this issue in washington and the reality is, clearly this state of the union shows two things. government spending is contracted whether you are democrat or republican. we are talking about the margins. the republican line of constant crisis and manufacturing crisis is simply not going to work politically. >> thank you. it's a great pleasure and we have breaking news. military officials say john allen is likely to withdraw his name and nomination to be the next commander in europe. he has been the top u.s. and nato commander in afghanistan. pentagon correspondent joins us with the latest. why is he withdrawing if this is accurate? >> we are told that he is strongly considering and more likely than not to withdraw his name. he hasn't made the final decision until he talks to

president obama. general allen got caught up in the sex and e-mail scandal involving then cia director david petraeus. in thousands of e-mails, several hundred were between general allen and a socialite down there in tampa. according to officials who have seen these e-mails, the vast majority were innocent about military events around tampa. a couple that some people in the obama administration and here in the pentagon thought were a little bit suspect. they had the inspector general here at the pentagon launching an investigation. after this exhausted investigation which was finally concluded and it was determined that general allen was involved in no misconduct, no inappropriate language or communications with this socialite, he was cleared of that.

in the meantime, his nomination to be the supreme allied commander of europe had been put on hold. the white house has not yet although they support allen has not yet sent that nomination back to the hill and we are told that general allen may not and is strongly considering withdrawing from the nomination because he doesn't want to resurrect that controversy and put he and his family through it. one other thing. there may be family health issues involved here. again, he has not met with president obama and we are told that if president obama tries to talk him into it to go ahead and accept the nomination that it is likely that general allen would decline. >> thank you very much. we are following another breaking news story. the search for the former l.a. cop accused of murder. christopher dorner. police are working to confirm whether dorner died in the shootout and fire at a cabin in

we have an update out of los angeles where police say the body believed to have belonged to fugitive christopher dorner has note yet been positively identified. dorner's case is still open and they will continue to be until

they have a positive id. sources tell us the charge remains found in the cabin belongs to doerper and dorner's driver's license was found near the. the family that he promised to target are still living in fear and we have amazing video of the gun fight that unfolded yesterday as a cbs reporter found himself feet away from the line of fire. >> one deputy was kill and another seriously identified. neither has been identified. we have the very latest. john, what is the timeline we are looking at here. dorner is a former police officer. would they have his dental records, for example, in archive to expedite this? >> they would have his dental records from family members and dna samples from his mother or sister. the san bernardino county coroner is examining the

remains. it's not clear how long it will take that make that id. if this was the final chapter last night, it was right out of a movie. he was holed up in one cabin, discovered when two women came to clean it and fled in of their vehicles and wracked that vehicle and was spotted by california fish and wildlife wardens and wrecked the first vehicle and had to steal another one at gunpoint. >> he came up to me with his gunpointed at me. he said i don't want to hurt you. get out and start walking up the road and take your dog which is what i did. >> he fled in that vehicle and passed another california fish and wildlife warden. as he passed, he rolled down his window and fired shots at the warden. the warden stopped and pulled out his rifle and fired at dorner as he fled down the road.

compromise. issues related to voters and the president highlighting 102-year-old woman whoa had to stand in line for hours. there is not a rush job that was brought up. prior to the election in november by democrats. you are right regarding immigration. looking at the big picture, that's the only way to stop the fever for the democrats to control the house. >> it depens on whether it's to get everything you want accomplished. president obama wants to get more accomplished, yes, having democrats taking back the house is their objective. i would say that will be difficult to do with redistricting. they want an election and only able to pick up eight house seats. you look at what president obama is doing and you are right. on the issues you laid out, he was building a trap that opposes them.

>> immigration is first on the list. i'm a naysayer and that gets through the house of representatives the day i see it. immigration is one. it still has a better chance than a lot of other things. i don't know. it's a tough list. boehner said the minimum wage is not going anywhere. i still think it's valued for him as the leader of the country to lay out a vision for what he thinks the society ought to look like. that still has value. >> quickly before we let you go, one of the things you took issue with today, republicans and what they stood up for during the state of the union and what they choose not to, no republicans standing for voting rights, the 102-year-old woman in the audience there. why do you take issue with this? we know this happens with the state of the union. >> i think they look really bad. they look self-is crediting.

float around. other show that net migration is negative. more people are going south than coming north and that substantial progress has been made. are we done? no. >> this comes after president obama renewed the call for immigration reform. joining me live, senior political reporter for politico and "usa today" contributor. raul, it was not just the president who addressed the comprehensive reform. rand paul and his tea party as well as senator marco rubio here. a lot of people are saying it is so linked to border security that we won't deal with the problem of immigration. >> that are has been the case in the past. they link it to enforce am. it's a stalling technique that they set new goals and can never be met and never go forward with comprehensive reform.

as much as i do support the dreamers and the rights of the immigrants, it seemed that the hearings, the timing was off in interrupting janet napolitano's questioning. she had a very important point to make as a former governor and current head of dhs. our borders have never been stronger. that was a terrific point. >> people are not coming into this country because there no jobs. it's part of the recession, right? >> the magnet has been jobs. it's a chicken and egg game. do we need to secure the borders first or jobs? most agree we need a solution. we go around and around in this type of game. >> michael was on a second ago with the daily beast. we were talking about the odds of what the president can be successful with with his agenda. immigration reform is the thing that people name instantly. he said you believe it when you see the vote from house republicans on this issue. what are the odds here?

are we too optimistic because we are hearing so many voices? >> i'm not sure we are too optimistic. i think there is a good chance and hashing out things now. the big issue is the path to citizenship. a lot of them don't know what's in the proposal yet. conservative members who will leave this fight say once they see what the proposals are and that calls for enforcement and border security. when you have people like jeff and marco rubio leaving this effort in the senate, i think it's going to have teeth. >> you mentioned the conservative members of the senate. i want to play what lindsay graham had to say about potential problems ahead. >> if i had to bet where this thing could run into a roadblock, it wouldn't be on the

pathway to citizenship as long as it's earn and not a special pathway. we are all signed up for that. e verify and some new system to control employment, we are all signed up for that. here's the friction point. temporary workers are needed in the future. a legal source of labor for american workers. the goal is not to displace an american worker. you can get a temporary worker when there is no american available at a competitive wage. >> the devil is in the detail. >> we're hear enough details from the president regarding work visas and the more complicated issues that may arise? >> no, but that's by design. the democrats are telling him to stay out of the details right now. if he starts putting down ultimatums or starts saying what he wants, republicans are going to run the other way. republicans will say it privately and democrats say it

speech and you see the ending there. chuck todd and others said it is so rare in the state of the union to see that kind of emotion. what are your thoughts? >> chuck is right. we were waiting for it. everybody knew gun control is the vote and it came towards the end of the speech. it was barack obama on the mountain top, if you like. he took kind of a pastor-like way of raising the roof of the joint session. it was chilling where he named all of those places with people who died of violence while he has been president. one of the things about the speeches, something that scholars years from now, 20 years or 100 years from now as an indicator of what's going on in the country and the president meat it clear that it was a deep concern of his. >> what about the choice of words, they deserve a vote. not saying what to do, but these

americans deserve a vote. >> i thought it was the right way to do it and brilliant. i don't know who wouldn't say let's at least have a vote on it. what are we doing if we can't vote on gun control measures and see how it plays out. i think he scored on that. there were a lot of historic moments and the media said part of it, he dealt with climate and then last night. i'm starting to think he is going to champion or educate the country about climate change and even connecting it to hurricane sandy last night. >> you heard the president refer to the warmest seasons we have seen on record. the incredible storms that we have seen as well. it has been greatly ignored. we talked a lot about immigration and we are just gate
